PyaarWoW Terms of Service

1. Acceptance of Terms
By accessing or using the PyaarWoW video communication application ("PyaarWoW," "the App," "our," "we," or "us"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the App.
PyaarWoW is a global video communication platform that enables one-to-one ("1V1") video interactions between users. The App is intended for users who are at least 18 years of age, or the age of majority in their jurisdiction, whichever is higher. Users under the age of 18, or the applicable age of majority, are not permitted to use PyaarWoW.
2. Account Registration and Security
2.1. To use PyaarWoW, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep this information updated.
2.2. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must immediately notify us at support@PyaarWoW-app.com of any unauthorized use of your account.
2.3. PyaarWoW reserves the right to disable, suspend, or terminate your account at its sole discretion, with or without notice, if it believes you have violated these Terms, our Community Guidelines, or any applicable law.
3. Acceptable Use and User Conduct
3.1. You agree to use PyaarWoW responsibly and lawfully. You are solely responsible for all conduct and content (including video, audio, text, and images) transmitted through your use of the App.
3.2. Prohibited Conduct. You agree NOT to:
a) Use PyaarWoW if you are under 18 years of age (or the age of majority in your jurisdiction).
b) Impersonate any person or entity or misrepresent your affiliation.
c) Harass, bully, threaten, intimidate, or stalk other users.
d) Transmit any content that is unlawful, libelous, defamatory, obscene, pornographic, invasive of another's privacy, or promotes violence or hatred.
e) Engage in or facilitate any form of child exploitation or abuse. PyaarWoW has a strict Zero Tolerance Policy for Child Sexual Abuse Material (CSAM). Any suspected activity will be reported to the relevant authorities, including the National Center for Missing & Exploited Children (NCMEC).
f) Transmit any unsolicited advertising, promotional materials, or "spam."
g) Use the App for any commercial sexual services, prostitution, or solicitation.
h) Violate any applicable local, national, or international law or regulation.
i) Attempt to circumvent, disable, or interfere with the security or operation of the App.
j) Use automated scripts, bots, or other means to access or collect data from the App.
3.3. We reserve the right, but are not obligated, to monitor, review, and remove any content or suspend/terminate access for any user we believe violates these Terms. Decisions are at our sole discretion.
4. In-App Purchases and Subscriptions
4.1. PyaarWoW may offer certain premium features or virtual goods for purchase ("In-App Purchases" or "IAPs"). All IAPs are processed through the Apple App Store or Google Play Store ("Platform(s)"), and their terms and conditions apply. PyaarWoW does not handle payment processing or store your payment information.
4.2. Fees and Billing. You agree to pay all fees associated with IAPs. Prices are subject to change without notice. Your IAP transaction is subject to the Platform's billing terms, conditions, and policies. Please review them before completing a purchase.
4.3. Refunds. Refund requests for IAPs must be submitted to and are governed by the policies of the respective Platform (Apple or Google). PyaarWoW cannot process refunds directly. Except as required by law or Platform policy, all sales are final, and we do not provide refunds or credits for any partially used subscription periods or unused virtual items.
4.4. Virtual Goods. Any virtual currency, credits, or items purchased within the App are digital licenses granted to you. They have no monetary value, are non-transferable, cannot be exchanged for cash, and are forfeited if your account is terminated.
5. User Content and Licenses
5.1. You retain ownership of the content you create, transmit, or display on PyaarWoW ("User Content").
5.2. By using PyaarWoW, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, host, store, reproduce, modify, adapt, and communicate your User Content to the extent necessary to operate, provide, improve, and promote the App. This license terminates when you delete your content or account, except as needed for legal/operational purposes (e.g., compliance with our legal obligations).
5.3. You are solely responsible for your User Content and its legality. You represent and warrant that you own or have the necessary rights to all User Content you provide and that it does not infringe any third-party rights.
5.4. We do not claim ownership of User Content. We are not responsible for the content, accuracy, or opinions expressed by users. User interactions are at your own risk.
6. Intellectual Property
6.1. The PyaarWoW App, its original content, features, functionality, logos, and trademarks are owned by PyaarWoW and its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use.
6.2. You may not copy, modify, create derivative works, reverse engineer, or attempt to extract source code from the App without our express written permission.
7. Privacy and Data
Your privacy is important. Our collection and use of your personal information are governed by our Privacy Policy, which is incorporated into these Terms. Please review it to understand our practices. By using PyaarWoW, you consent to the data practices described in the Privacy Policy.
8. Disclaimer of Warranties and Limitation of Liability
8.1. Disclaimer. THE PyaarWoW APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
8.2. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PyaarWoW, ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE APP.
8.3. Cap on Liability. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO PyaarWoW IN THE PAST SIX MONTHS, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.
8.4. Exceptions. THE ABOVE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW, SUCH AS LIABILITY FOR DEATH, PERSONAL INJURY, OR FRAUDULENT MISREPRESENTATION. THIS LIMITATION IS INTENDED TO APPLY TO THE FULLEST EXTENT PERMITTED BY THE APPLICABLE PLATFORM STORE'S POLICIES (APPLE APP STORE, GOOGLE PLAY).
9. Indemnification
You agree to defend, indemnify, and hold harmless PyaarWoW, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the App; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any law or the rights of a third party.
10. Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App ceases immediately. You may also terminate your account by contacting us or deleting the App.
11. Governing Law and Dispute Resolution
11.1. Governing Law. These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.
11.2. Informal Resolution. We prefer to resolve disputes informally. Please contact us at legal@PyaarWoW-app.com with any concerns first.
11.3. Binding Arbitration. For any dispute we cannot resolve informally, you and PyaarWoW agree to resolve it through final and binding individual arbitration administered by the Singapore International Arbitration Centre (SIAC) under its rules, rather than in court. The seat of arbitration is Singapore. Judgment on the award may be entered in any court with jurisdiction.
11.4. No Class Actions. YOU AND PyaarWoW AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THIS WAIVER APPLIES TO CLASS ARBITRATION.
11.5. Exceptions and Opt-Out. This arbitration agreement does not preclude you from bringing issues to the attention of federal, state, or local agencies. If you are a consumer in a jurisdiction that provides for non-waivable court access (e.g., the European Union), this clause may not apply to you. You may opt-out of this arbitration agreement within 30 days of first accepting these Terms by emailing us at beautifullymadegames@gmail.com with your username and a clear statement of your wish to opt-out.
12. General Provisions
12.1. Entire Agreement. These Terms, along with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and PyaarWoW.
12.2. Severability. If any provision of these Terms is held invalid, the remainder shall remain in full force.
12.3. No Waiver. Our failure to enforce a right is not a waiver of that right.
12.4. Assignment. We may assign our rights under these Terms. You may not assign yours without our prior written consent.
12.5. Changes to Terms. We may modify these Terms. We will provide notice of material changes via the App or email. Your continued use after changes constitutes acceptance.
